These Terms of Service ("Terms") govern your use of the Botomout website and the engagement of Botomout's services. By using this website or engaging our services, you agree to these Terms.
1. Services
Botomout provides website development, custom software, mobile app development, design, cloud, security, consulting and related IT services. Specific scope, deliverables, timelines and pricing for any engagement are defined in a separate written proposal or agreement, which takes precedence over these general Terms where they conflict.
2. Quotes & estimates
Figures shown on this website — including plan pricing and the interactive project estimator — are illustrative only and do not constitute a binding offer. A binding quote is issued only after a scoping discussion, in writing.
3. Payment terms
Payment schedules are defined per project or subscription plan. Monthly plans are billed in advance and may be cancelled at the end of a billing cycle. Fixed-price projects typically follow a milestone-based payment schedule set out in the project proposal.
4. Intellectual property
Unless otherwise agreed in writing, ownership of custom deliverables (source code, designs, content created specifically for a client) transfers to the client upon full payment. Botomout retains ownership of its own pre-existing tools, frameworks and internal know-how used to deliver the work.
5. Client responsibilities
Timely feedback, access to necessary systems, and provision of accurate information are the client's responsibility, and delays in these areas may affect project timelines.
6. Warranties & limitation of liability
Services are provided with reasonable skill and care. To the fullest extent permitted by law, Botomout's liability for any claim arising from these Terms or a related engagement is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect or consequential damages.
7. Termination
Either party may terminate an ongoing engagement per the notice period specified in the relevant project agreement or plan terms. Fees for work completed up to termination remain payable.
8. Governing law
